2. Intellectual Property and Ownership

Upon full payment for the Services, you will receive a non-exclusive, worldwide, royalty-free license to use the final animated product ("Final Product") for your business and promotional activities. We retain all rights to the underlying assets, including but not limited to, project files, design elements, and source code used to create the Final Product. We also reserve the right to display the Final Product in our portfolio and marketing materials.

3. Payment and Fees

All fees for the Services are due in full and upfront before any work begins. Payments are non-refundable except as specified in these terms. We reserve the right to suspend or terminate services if payment is not received in a timely manner.

4. Project Delivery and Revisions

Once the Final Product is delivered, you are entitled to a specific number of revisions as outlined in your chosen service package. Revisions must be requested within a set number of days (e.g., 7 days) of the initial delivery. Requests for revisions after this period, or requests exceeding the number allowed, may be subject to additional fees at our sole discretion. We are not responsible for delays caused by client-side issues or slow feedback.

5. Client Content and Responsibilities

You are solely responsible for providing all necessary content for the project, including, but not limited to, logos, brand guidelines, text, scripts, audio files, voiceovers, and images. This content must be provided in the specified format and by the agreed-upon deadlines.

You expressly warrant that you own the rights to, or have obtained all necessary licenses for, any and all content you provide to us. You agree that this content does not infringe on any third-party intellectual property rights, including copyrights and trademarks.

You agree to indemnify, defend, and hold us harmless from any and all claims, damages, or liabilities arising from the use of content you provided, including but not limited to, copyright or trademark infringement claims. We will not be held liable for any legal issues or damages resulting from the use of your content.

6. Limitation of Liability

In no event shall we be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Services, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these Services shall not exceed the total fees paid by you for the specific service in question.

7. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Colorado, USA, without regard to its conflict of law provisions.

8. Amendments to Terms

We reserve the right to modify these terms at any time. We will provide notice of any significant changes by posting the updated terms on our website. Your continued use of the Services after such changes constitutes your acceptance of the new terms.
